4. Limitation of Liability

5. Non-Refundable Payments and Buy-and-Take Framework

K44 operates exclusively on a "buy-and-take" transactional basis, whereby each transaction is singular and devoid of any recurring subscription, renewal, or ongoing obligation. Upon delivery of the contact information to the Purchaser, all sales are irrevocable, final, and non-refundable. K44 unequivocally renounces any obligation to provide reimbursements, replacements, or credits, irrespective of the Purchaser’s attainment, or lack thereof, of the anticipated benefits.

6. Assumption of Risk and Acknowledgment of Uncertainty

The Purchaser agrees to indemnify, defend, and hold harmless K44, its proprietors, officers, agents, and affiliated entities from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorney’s fees) arising out of or in connection with:

The Purchaser’s use or misuse of the contact information.
Any third-party claims or legal proceedings initiated as a consequence of the Purchaser's actions.
The Purchaser's breach of these Terms and Conditions or of any applicable laws, whether domestic or international.

9. Absence of Relationship with Contacted Individuals

The Purchaser comprehends and accepts that K44’s function is restricted solely to the delivery of randomly curated and validated contact data, devoid of any influence over the responses, actions, or preferences of the individuals contacted.

10. Disclaimer of Warranties

Our services are rendered strictly on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, K44 categorically disclaims all warranties, express or implied, including but not limited to:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
